In U.S. v Stricker, the government has stated its position unambiguously concerning the people and companies whom it intends to hold responsible for the payment of Medicare liens and the scope of the lien obligation.
In U.S. v. Harris, the United States District Court for the Northern District of West Virginia entered summary judgment against the lawyer who obtained a settlement for a claimant/Medicare beneficiary, requiring the lawyer to pay the entire amount of the lien claimed by Medicare, plus interest, because the lien was not satisfied out of the settlement proceeds.
